Suspended Magistrate Brian Khaemba Resigns To Join Public Practice With Dunstan Omari

Brian Khaemba has formally resigned as a senior magistrate in Kiambu and moved to private practice.

Khaemba made his first appearance as advocate yes- terday in a criminal case involving private investigator Jane Mugo who has sought the court’s pro- tection following claims of death threats.

He has taken up work at Musyoki Mogaka Company Advocates who are representing Mugo in the case.

Khaemba opted to resign from the bench after efforts to reinstate him as a judicial officer hit a snag.

Private detective Mugo filed an

affidavit before court alleging her life was in danger and sought State protection.

“Our client’s life is in danger. She is afraid of the investigators in the case. We urge for the court’s pro- tection as we intend to reveal the context of the threats,” the defence said.

In their submission her lawyers , Khaemba and Dunstan Omari said it was through God’s mercy that Mugo is alive.

“She has worked as a police informer for 15 years and under- stands the operations . She is here in court because her life is in dan- ger,” said Omari.

The lawyers urged the court to take judicial notice following a Citizen TV story that saw CS Fred Matingi’a order for investigation.

“Kindly make that order that the relevant authorities enhance her security as any further delay to ac- cord her security will be exposing her to risks,” said the defence.

Omari told Magistrate Martha Mutuku that Mugo started receiving threatening calls in August, a matter that was reported at the Central Police Station in Nairobi. She says several letters of com- plaint to relevant authorities over the same have been recorded.

Mugo claimed threats to her life and family began in 2014 and de- spite reporting, none of the cases has been closed.

“In the course of my assign- ment, my staff and I have received threats in different forms including receiving calls and on social media platforms,”she said in an affidavit.
