Court Rules That Babu Owino Is Still Innocent And Not Mandated To Pay DJ Evolve’s Medical Bill
A reprieve came to the Embakasi MP after the high court reviewed down his bail terms. Babu who was accused of attempted murder following a recorded shooting on DJ Evolve at B-Club, was released on a Sh10M cash bail.
Following an appeal by Babu over his bail terms, Justice Luka Kimaru then lowered the cash bail for the Embakasi East MP to Ksh.5million from the initial Ksh.10million.
While the magistrate in the lower court had initially ruled that Babu was to take care of the medical expenses of DJ Evolve who has since been in ICU at Nairobi Hospital, High Court faulted the ruling.
According to Justice Kimaru, the consideration for cash bail to be used for treatment for the DJ was not proper as an accused person is innocent until proven guilty.
Justice Kimaru further noted that Mr. Owino had so far paid Ksh.4.4 million to the court that was to be used in settling the hospital bill and Ksh.600,000 directly to the health facility.
However, he noted, only the Ksh.4.4million will count as bail.
Felix Orinda, DJ Evolve is said to be in unstable condition, unable to speak and only feeding through tubes. As of 23rd February, the bill had accumulated to Sh6.6M and it’s like way above now.
Having paid Sh600,000 directly to the hospital, the court is treating the amount as a kind gesture to the victim and they Babu now only has to pay Sh600,000 to the Sh4.4M that he already had paid to the court to make it Sh5M to secure his release.
