Three Charged With Sh1.6B Land Fraud

They are accused of falsely issuing it in favour of Beba Freight Limited and misrepresenting it as a genuine title deed from the Ministry of Lands.

Two men have been charged with conspiracy to defraud a company of a parcel of land in Nairobi’s Loresho area worth Sh1.6 billion.

John Gitau Ngumi and Atek Otech Richard appeared before Milimani Magistrate Benmark Ekhubi and denied the charges.

A third suspect, Bernard Otieno Mallo was not in court and he will plead to the charges at a later date.

The duo are accused that on an unknown date and place within the country, jointly with others not before Court, they allegedly conspired with intent to defraud Landmark Freight Services Limited of a Parcel of land Reference Number 21068, measuring approximately 0.6724 hectares.

The charge stated that they defrauded the company of the land worth Sh. 1.6 billion by falsely pretending that they were the genuine owners of the land.

The duo jointly were further accused of making a false title deed (Grant) I.R. No. 143069 in favour of Beba Freight Limited purporting it to be a genuine and valid document issued by the ministry of lands.

Mallo is accused of knowingly and fraudulently uttering a fake Title Deed (Grant) I.R. No. 143069 for Land Reference Number 21068 in the names of Beba Freight Ltd to the Deputy Registrar ELC Nairobi purporting it to be a genuine document issued by the Ministry of Lands.

The charge said he committed the offence on the 2nd day of July, 2024 before the Environment and Land Court at Nairobi.

The duo were further accused of making a false Allotment letter Ref. No. 57458/XVI dated 6th July, 1995 in favour of 2025 Beba Freight Ltd purporting it to be genuine and valid document d by the Commissioner of lands.

It is alleged that they made the fake document on unknown date and time, with intent to defraud.

Mallo is separately charged with knowingly giving false testimony touching on a matter that was pending in court.

It is alleged that he committed the offence on the 2nd day of July, 2024 before the Environment and Land Court at Nairobi within Nairobi City County, in a judicial proceeding in the Land Case Number E264 of 2024-Beba Freight Company Limited Vs Bharat Ramji Manji and 3 Others.

The affidavit container in a supporting affidavit dated 2nd of July, 2024 was sworn before Ruth Emanikor, a Commissioner of Oaths and was filed in a land case,

Ngumi and Atek were released on a cash bail of Sh250,000 each.
