Mithika Linturi Impeached
Parliament approves the motion to impeach Agriculture CS Franklin Mithika Linturi over fake fertilizer scandal.
This now leads to the formatio11-member select Committee to investigate impeachment charges against the CS.
149 supported the motion while 36 objected.
The impeachment motion was tabled by Bumula MP Jack Wamboka who is seeking the removal of Linturi over gross misconduct and violation of Kenya’s constitution.
What next?
1. Following the resolution of the Special Motion relating to the removal of Franklin Mithika Linturi from the Office of Cabinet Secretary for Agriculture and Livestock Development, Article 152(vii) of the Constitution requires that;
– if the motion is supported by at least one-third of the Members of the National Assembly, the Assembly shall appoint a Select Committee comprising eleven of its members to investigate the matter and the Select Committee shall within ten days submit its report to the Assembly whether it finds the allegations against the Cabinet Secretary to be substantiated.
2. The next step to be taken, therefore, is the appointment of members to the Select Committee to investigate the matter.
3. In this regard, National Assembly Speaker, Moses Wetangula, has directed that the Parliamentary Parties in the House expeditiously nominate Members to serve in the Select Committee and submit the names to the Office of the Clerk to be published in the Order Paper.
4. Thereafter, once the names have been published in the Order of Paper, the Leaders of Majority and Minority sides will expedite the consideration of the names and bring the relevant motion to the House for approval so as to commence the consideration of the matter of impeachment.
5. House Speaker Moses Wetangula has directed that Membership to the Select Committee will be distributed as follows;
a. Majority Party – 6 Members
b. Minority Party – 4 Members
c. Jubilee Party – 1 Member
7. In nominating the Members, Parties are to ensure that the nominees to the Committee reflect the diversity of the House, including regional and gender considerations.
8. The Constitution requires the Select Committee to conduct investigations and report back to the House within ten days. In this regard, the Parties should provide to the Speaker the names of their nominees not later than today, Thursday 2nd May 2024, by 1.45pm.
9. Thereafter the House will sit to consider the nominees to the Select Committee during the Afternoon sitting.
10. The names, once brought, will be subjected to a vote by the House, and thereafter the Speaker will give further direction to the Committee on how they will conduct the matter.
