Kairo Released On Sh2M Cash Bail, Court Rules He’s Not At Flight Risk
Kairo faced two separate charges of cheating contrary to section 315 of the penal code.
Nairobi – City car dealer Joseph Kairo, popularly known as Khalif Kairo, has been released on a cumulative cash bail of Sh2 million following his denial of charges related to failing to honor car sale agreements. The ruling was handed down by Milimani Chief Magistrate Lucas Onyina at the Milimani Law Courts.
Kairo faced two separate counts of cheating, as outlined under section 315 of the Penal Code. Each charge carried a cash bail of Sh1 million, with an alternative option of bond.
Magistrate Onyina, in his decision, stated that he saw no evidence to suggest that Kairo posed a flight risk, thus justifying the bail.
Kairo faced two separate charges of cheating contrary to section 315 of the penal code.
For each of the charges, the court granted him a cash bail of Sh1 million with an alternative of a bond.
According to one of the charges, Kairo on diverse dates between July 10, 2024, and July 25, 2024, at Westlands by means of fraudulent tricks induced one Jeff Munane to pay him Sh2.1m.
The money was allegedly paid to him through his company Kai&Kairo Limited and was for the importation of a Honda Vezel hybrid from Japan which the charge sheet indicates he never delivered.
He allegedly committed the same offence against one Dona Okoth.
The charge sheet claims that Dona transferred Sh2.98 million into Kai and Kairo Limited’s KCB bank account.
The money was paid for the purchase of a Subaru Outback ‘a fact Kairo knew to be false’.
This offence is said to have been committed on diverse dates between July 29, 2024 and 16 November 2024.
The Prosecution had sought to have him denied bail on the grounds that he was a flight risk.
But Onyina in his ruling said the charge facing Kairo is a misdemeanor and he is unable to see any reason why Kairo should not be granted bail.
With respect to the charge involving Sh2.9M, Onyina said ” The accused persons is released on a cash bail of sh 1million with one contact person. His passport will be deposited with the senior court administrator and the trial shall be fast tracked,” For the charge involving sh 2.1M Kairo was granted a cash bail of sh 1million with an alternative of sh 1million bond. The court set January 28 as the pre-trial date.
