Kisii Politician Charged With Sh1.6M Fraud

A politician from Kisii has been charged at a Nairobi court with conspiracy to obtain Sh1.6 million by falsely pretending to be in a position to execute a court order from Mavoko Law Court.

Credius Nyamwange Oigara who was contesting for the Bomachoge parliamentary seat was charged alongside Kenneth Korir who did not ap- pear in court with the offence of conspiring to defraud a trader, James Njukia Ihura the said money.

The prosecution told the court that on diverse dates between April 13 and April 15 2023 in Nairobi county, the duo conspired to defraud Ihura who is trading as Manyota Investment Limited by pretending that they were in a position to effect an eviction order issued by Mavoko Law Court regarding the case E057/2022.

Separately, Oigara was charged with obtaining money by pretences and posing as an advocate of the High Court.

The court heard that Oigara obtained Sh1,600,000 from Ihura on diverse dates between April 5 and 15, 2023.

In order to accomplish his mission, the prosecution told the court that Oigara jointly with another who was not in court posed as advocates of the High Court on April 5.

He appeared before the Milimani Senior Principal Magistrate Benmark Ekhubi and denied the charges.
The prosecution did not op- pose his release on bond.

The defence prayed for leniency citing that his client is a known public figure who is not a flight risk,
“My client is a known public figure and his residence is known hence praying his release on lenient bond terms,” the defense prayed.

He was released on bond of Sh500,000 with a surety of similar amount or alternative cash bail of Sh300,000 with one con- tact person.

The magistrate further issued a warrant of arrest against Korir who failed to appear in court for plea taking.

The matter will be mentioned on October 15 for pre-trial and directions
